Who we are and what this policy covers

Vanguard Performance LLC operates Vanguard and Filia from 2901 Cleveland Ave., Suite 102, Santa Rosa, CA 95403. This policy covers personal information Vanguard handles for the medication program, including merchant administration, support, communications and this website. It also explains the separate roles in the Architek-supported clinical pathway; it does not remove our responsibilities for information we receive simply because a clinical interface is hosted elsewhere. The treating practice and pharmacy’s notices govern their own records and activities, including applicable HIPAA duties.

Information you give us

When you contact Vanguard we receive the contact details, request and other information you choose to send. Merchant administration involves the identifying, transaction and order information needed to process or explain a charge, manage a cancellation/refund, keep business records and answer a service request. A medication choice or order can reveal health information even without a diagnosis. Limit support messages to what is necessary and do not send medical histories, identity documents or full payment-card numbers in ordinary email.

Clinical information and the branded pathway

The clinical evaluation uses identifying and location information, medical history, medicines, allergies, treatment goals, answers to clinical questions and relevant supporting information supplied for the clinician’s review. Architek provides the branded technology and clinical communications; Architek Health Provider Network PC, the independent professional group, uses clinical information to evaluate, prescribe and follow up. A pharmacy uses the prescription and necessary patient and delivery information to dispense. The clinical record is not made public by a brand interface. Any information Vanguard receives from that pathway remains subject to our privacy duties and the applicable permissions; this policy is not a blanket authorization for unrestricted clinical-record access.

Information from other service participants

Program participants may supply the information needed for their role: the clinical service for evaluation-related administration and communications, a dispensing pharmacy for prescription fulfillment, and payment and operational providers for transaction, fraud, support and delivery matters. What a clinician shares is subject to patient permissions and applicable law; the platform does not obtain permission for every medical record merely by linking to a survey. We do not buy health information from data brokers or infer a health profile for advertising from your browsing.

Website data and browser preferences

Hosting and security systems process technical requests such as IP address, browser information, requested page and timestamp to deliver and protect the website. The application stores an appearance preference in your browser; you can clear it in browser settings. These public pages do not use customer login or cart cookies, advertising pixels, analytics, session replay or cross-site profiling. They have no intake, upload or payment form. These technology statements describe the public pages. The clinical portal’s processing and controls are addressed in its applicable portal and practice privacy information; each participant remains responsible for its own systems and duties. For the pages operated by Vanguard and Filia, we use a common cookie-and-consent policy and update it before enabling a new tracking tool.

Why information is used

Information is used to provide the service requested: administer merchant transactions, route and resolve support, communicate about the program, enable the responsible clinical or dispensing service to perform its role, maintain consent and preference records, prevent fraud, secure systems, and satisfy applicable accounting, legal and record obligations. Clinical decisions are made by the treating clinician. Marketing requires its separate choice; receiving a clinical message is not enrollment in marketing. We do not use health information to train artificial-intelligence models or target advertising.

Who receives information

Information is limited to recipients with a relevant service or legal purpose: Architek for the branded clinical technology and communications; Architek Health Provider Network PC for evaluation and treatment; the dispensing pharmacy for its prescription and delivery responsibilities; payment providers for authorized transactions; and providers of hosting, security, communications or support for their assigned functions. Each participant’s role and applicable privacy duties still apply. We do not give an employer, insurer, advertiser or data broker access to health information for its own unrelated use. A valid legal demand is reviewed under applicable law rather than treated as an unrestricted request.

Brands and business changes

Vanguard and Filia have the same operator. Shared ownership does not authorize one brand to use another brand’s health information for marketing, or let a customer view another customer’s records. Access is limited by service responsibilities and permissions. A business transfer does not permit information to be used outside this policy without the notice, consent or other safeguards the law requires.

Sale, sharing and advertising choices

We do not sell, rent or trade personal or consumer health information, share it with advertising platforms for cross-context behavioral advertising, or use medication interests for targeted ads. We do not sell de-identified health data. You may make a Do Not Sell or Share request through Contact, without creating a new account. We automatically honor Global Privacy Control and Do Not Track signals as requests to opt out of sale or advertising sharing. These public pages do not carry out those activities, regardless of whether a signal is sent. These commitments apply to Vanguard, not as an unsupported assertion about an independent company’s unrelated activities.

Email and other communications

Architek sends branded clinical transactional messages through its system. Use the clinical service’s instructions for care, refills and clinical-message preferences. Vanguard handles its own merchant/support and optional marketing communications. You can withdraw marketing consent through an unsubscribe link or by contacting us; marketing consent is not required for clinical evaluation. Do not rely on ordinary email for urgent care or sensitive record exchange. We do not add a marketing text-message program through this website.

Retention and deletion

Retention depends on the purpose and applicable duties: transaction and tax records may need to remain after a service ends; clinical records are subject to the practice’s and pharmacy’s medical-record obligations; support, preference and security records are retained only as needed for their service, security and legal purposes. A deletion request is assessed for the records we hold and passed to relevant processors where required. If some information must be retained, we explain the applicable limitation and restrict its use; we do not promise that deleting a website preference deletes an independent clinical record.

Security and incident notices

Access must be limited to the people and systems with a service need, with appropriate technical, organizational and contractual safeguards for the information and role. HTTPS protects transport to this website. No system is risk-free. We investigate suspected unauthorized use and provide notices required by the applicable breach laws; this policy does not use a HIPAA badge as a substitute for actual responsibilities. Contact us if you suspect misuse, without emailing the affected medical record or a password.

Your rights and how to request them

You may ask what information we hold about you, receive a copy, request correction or deletion, ask about recipients, withdraw an applicable consent, and make an applicable sale/sharing opt-out or sensitive-information request. Contact the brand business email or write to the operator address. Describe the right you want to exercise and how to reach you; do not attach identity documents or clinical records to the initial request. We verify identity using information reasonably needed and provide a safer method if sensitive information is necessary. An authorized agent may make a request with appropriate proof of authority. You need not create a website account to ask.

Responses, appeals and clinical records

We respond within the applicable legal time limits and explain a permitted extension or a decision not to fulfill a request. If you disagree, reply asking for an appeal so it can be reviewed; you may also complain to your state attorney general or another applicable regulator. We do not retaliate for exercising privacy rights. For a clinical record or HIPAA right, contact the practice or pharmacy holding it; we can help route the request. Withdrawal may prevent a service that needs the information, but does not undo a lawful use already made or eliminate required record retention.

Children and clinical eligibility

The Architek platform is for users 18 and older; the clinician also applies the relevant clinical eligibility criteria. Do not submit someone else’s information as your own or provide a child’s medical information through public website contact. If you believe we received information about a child improperly, contact us so the relevant records and duties can be reviewed. This privacy section is not a substitute for the program’s actual eligibility conditions.

Changes and contact

A changed policy is identified by its new version. A change is not permission to use information already collected in a materially different way without the notice or consent required by law. For privacy questions, rights requests or legal notices, use Contact or write to Vanguard Performance LLC, 2901 Cleveland Ave., Suite 102, Santa Rosa, CA 95403. The separate Consumer Health Data & Privacy Rights notice provides additional health-data detail.
