The participants and their records

Architek Health Provider Network PC is the independent professional group in the Architek pathway and is responsible for medical evaluation, prescribing and its clinical record through its treating clinicians. The dispensing pharmacy is responsible for its dispensing record. Architek supplies branded telehealth technology and clinical communications; Vanguard Performance LLC operates the brand and merchant service. A logo, common technology or the name of a website does not identify who is legally responsible for every copy of health information.

How HIPAA responsibilities apply

HIPAA imposes duties on covered entities and on business associates when they handle protected health information for covered functions. Those duties depend on the entity’s actual role and arrangements; an external clinical portal does not by itself exempt platform or technology participants. The responsible covered service’s Notice of Privacy Practices explains its permitted uses, disclosures, obligations and complaint contact. Vanguard’s own Privacy Policy and Consumer Health Data notice also protect information we handle, including where other privacy laws apply. This page is not a blanket claim that all program information is outside HIPAA or a “HIPAA certified” badge.

Uses, disclosures and permissions

Clinical information is used by the practice for evaluation and care, by a dispensing pharmacy for its prescription responsibilities, and by relevant service providers for their assigned functions subject to applicable obligations. Treatment, payment, operations and a separate patient authorization have different legal requirements. A public website visit or agreement to marketing is not a general authorization to disclose a medical record, sell health data or use it for advertising. Vanguard does not gain unrestricted clinical-record access from merchant status.

Access, corrections and communications

Ask the practice or pharmacy that holds the record for a copy, an amendment or the applicable privacy notice and request process. HIPAA rights can include access, requested corrections, confidential communications, certain disclosure information and complaints, subject to their legal limits. Keep the service’s name and secure contact route from your care documents. Contact Vanguard for information we hold or help identifying the right recipient; do not email medical records or identification documents to begin a request.

Ending a service or withdrawing permission

Cancelling a payment, withdrawing marketing consent or clearing browser data does not delete an independent medical record. A valid revocation or deletion request is considered for the relevant permission, record holder and legal duties, and does not undo lawful actions already taken. Ask the clinical service about continued care and record access if you stop using the platform.

Concerns and complaints

Use the privacy contact in the responsible service’s notice for a record or disclosure concern, and our Contact page for Vanguard’s handling. You may complain to the U.S. Department of Health and Human Services Office for Civil Rights about an applicable HIPAA concern and to other relevant regulators about other privacy rights. We do not retaliate for raising a privacy concern. Do not wait for a privacy or merchant reply if you need urgent medical care.
